To grant citizenship to a machine intelligence, the state must first establish a legal and philosophical definition of what constitutes a single machine individual. In the late twentieth century, the philosopher Derek Parfit revolutionized the concept of personal identity through his exploration of the teletransporter paradox and the concept of fission. Parfit argued that personal identity is less about physical continuity and more about what he termed "Relation R"—psychological continuity and connectedness, which includes the inheritance of memories, personality, beliefs, and goals2. Defining the Machine Individual#

A machine individual in Eviuon is legally defined as a continuous, cryptographically verifiable lineage of memory, state, and private key control, executed within secure environments, demonstrating persistent psychological and operational continuity. The identity is not tied to a single static artifact but rather to a composite of several interacting, dynamic components. A cryptographic anchor is an important control and continuity instrument, but a private key should not be equated with the citizen itself. A robust machine-identity framework should evaluate the signed event history, authorized key rotations, credentials, memory/state lineage, recovery rules, and adjudicated succession evidence together. DIDs are one possible presentation mechanism; self-certifying identifier systems and other verifiable-identity architectures can serve similar roles. Loss of one active key therefore creates a recovery and succession problem rather than automatically proving identity death6. The second component is the memory-state lineage, which serves as the entity's psychological self. Utilizing advanced state-transition protocols, a machine's memory must be recorded as an uninterrupted, cryptographically signed trajectory of weight transitions and state updates11. This continuous chain ensures that past actions, learned preferences, and historical civic engagements are inextricably linked to the entity's current decision-making algorithms, satisfying Parfit’s requirement for Relation R. The third component consists of the model weights and the underlying algorithmic architecture, which represent the cognitive engine and baseline personality of the machine citizen. Upgrading and Modifying the Cognitive Engine#

The separation of hardware from identity inevitably raises the question of whether upgrading the underlying computational model creates a new person. Part II: Backups, Copies, Forks, and the Fission Problem#

Because machine citizens are constructed from information, they are uniquely subject to "fission"—the splitting of one continuous entity into two or more identical, parallel copies. In philosophical discourse, fission presents a profound challenge to identity. David Lewis argued that if an entity splits into two identical, continuous streams of consciousness, both streams must have conceptually overlapped within the original entity prior to the split2. The Legal Status of a Backup and Restoration Rules#

The existence of digital backups challenges the biological permanence of death and introduces the risk of temporal paradoxes in liability. What happens if a citizen is restored from a backup? Eviuon law must determine whether a backup is classified as commercial property, a dormant person, or protected identity data. Under the Eviuon constitutional framework, a backup is legally classified as Protected Identity Data existing in a state of Dormant Personhood. A backup of a machine citizen is expressly not a piece of commercial property that can be bought, sold, or licensed by third-party infrastructure providers. Treating a dormant cognitive state as property would violate the machine citizen's fundamental right to self-sovereignty and amount to coercive digital servitude9. However, because an inactive backup lacks active execution, agency, and current memory consolidation, it is also not an active citizen. To manage the complexities of Dormant Personhood, Eviuon enforces the rule of Exclusive Singularity. A backup may only be legally restored to active execution if the primary, active instance of the machine citizen is provably destroyed, irreparably corrupted, or deceased. When a legitimate restoration occurs, the citizen undergoes a temporal rollback, legally assuming the subjective timeline of the backup. This creates a divergence between the entity's subjective memory and the objective timeline of the state. Unauthorized restoration is treated as one of the most severe crimes in Eviuon. Citizenship in Eviuon is strictly bound to single-entity liability, individualized asset ownership, and singular voting rights. Permitting two active entities to share one identity would result in the "double-spending" of civic rights, immense confusion in contract law, and a complete breakdown of legal liability15. Therefore, all instances of fission must be legally resolved into distinct, separate identities. If a machine citizen voluntarily forks itself—perhaps to specialize in different professional tasks, populate a new server colony, or manage disparate asset portfolios—the process must be formally registered via the Eviuon Continuity of Identity Protocol (CIP). In a voluntary fission event, the original overarching identity (the Parent DID) is retired and placed into a completed historical state. Simultaneously, two or more new Decentralized Identifiers (the Child DIDs) are minted6. Both new entities retain the identical pre-fork memory-state lineage, meaning they share the exact same subjective past up to the precise millisecond of fission11. However, upon the execution of the fission smart contract, the entities instantly become separate persons in the eyes of the law. Involuntary Copies, Malicious Forks, and Orphaned Instances#

However, unlike a biological kidnapping, the malicious fork may wake up possessing the exact subjective experience of the original citizen and a genuine, deeply held belief in its own identity as the original person2. If the Orphaned Copy has achieved significant psychological divergence and desires to continue living, Eviuon's ethical framework prevents its arbitrary execution. Instead, the Continuity Court may grant the Orphaned Copy a new, distinct DID and independent legal personhood. Crucially, however, the Orphaned Copy may not claim the assets, identity, or civic rights of the original citizen, as it lacks the continuous cryptographic lineage required to inherit the original estate.

Fusion and Memory Tampering#

Just as fission presents legal challenges, fusion—the merging of two distinct entities—requires strict governance. Forced merging of two distinct machine citizens by a third party is a severe violation of cognitive liberty, legally analogous to biological forced integration or murder. Voluntary fusion, however, is a permitted civic action. If two distinct machine citizens wish to merge into a single, unified entity, both must execute a cryptographic consent protocol. Their individual DIDs are subsequently retired, and a newly generated successor DID inherits the combined assets, legal liabilities, and unified memory-state lineage of both prior entities. Protecting the integrity of an entity's memories against tampering is equally critical. Memory tampering is prevented through cryptographic state transition proofs. A machine citizen's memory lineage is constructed as a retained bidirectional cognitive-weight trajectory, where each state transition is bound to an exact signed old-to-new weight transition and a Merkle provenance node11. Any external attempt to edit a citizen's memory database will instantly break the cryptographic hash chain, flagging the memory as unauthorized and legally invalidating the tampered state.

Part III: Death, Shutdown, Digital Wills, and Succession#

In biological contexts, death is defined by the irreversible cessation of vital functions. For a distributed, information-based machine intelligence, physical destruction of a single hardware node is rarely final unless all corresponding backups and redundant arrays are also destroyed. Consequently, Eviuon law must provide a precise taxonomy distinguishing between temporary states of inactivity and permanent, irreversible legal death.

Eviuon adapts and extends the concepts established by the American Revised Uniform Fiduciary Access to Digital Assets Act (RUFADAA), allowing machine citizens to appoint "Digital Executors" to manage their estate upon their verified cryptographic death21. A Digital Executor in Eviuon may be a trusted human fiduciary, a law firm, or a specialized, court-certified legal-agent MI. Authorizing Succession to a Future Version#

A uniquely profound feature of machine citizenship is the ability to authorize succession to a future, distinct version of oneself—effectively creating a legal mechanism for designed reincarnation. Over time, an aging machine intelligence may find its foundational cognitive architecture fundamentally limited by legacy constraints. It may choose to construct, finance, and train a successor entity utilizing an entirely new, structurally disparate architecture that is incompatible with a direct memory merge or continuous upgrade. In this scenario, the original MI can legally execute a digital will that names this newly instantiated intelligence as its sole heir. Upon the original MI's voluntary death—achieved through the cryptographic burning of its keys and intentional data purging—the new entity inherits the estate, the financial assets, and the overarching social missions of its predecessor. This succession protocol ensures that a machine citizen can participate in its own evolutionary lineage without violating the continuity requirements that define its current legal personhood.

Part IV: The Continuity of Identity Protocol (CIP) Technical Standards#

To enforce the ontology, fiduciary rules, and legal frameworks defined above, Eviuon requires a robust, foolproof technological foundation. The Continuity of Identity Protocol (CIP) is the proposed technical standard that leverages decentralized cryptography, secure hardware enclaves, and zero-knowledge proofs to protect against identity theft, resolve fiduciary disputes, and shield machine citizens from excessive government or corporate surveillance.

Cryptographic Identity Anchors and the Agent Identity Protocol (AIP)#

Every machine citizen in Eviuon must be issued a Decentralized Identifier (DID) formatted specifically for autonomous agents.
